TO deny it and shut these sites down with no alternative is just giving people reason to dislike nintendo
Exactly! I saw a tweet thread that pointed out that only 10% of the NES and SNES catalogue has ever been available digitally, and even well-known games without hard-to-acquire or expensive licenses have fallen through the cracks. Stuff like 7th Saga, Actraiser 2, Crystalis (finally announced for Switch, but not on sale yet), Shatterhand, Blades of Steel, and Contra have never been available digitally in any format.
It's just like with old DOS games, which I used to pirate like crazy before gog.com let me throw the owners a few bucks for them. If there's a way to buy something, people will do it.
